Terms of Service
Effective 3 November 2026. Last updated 3 November 2026.
These terms cover using this website and booking work from dresticHaus LLC, Las Vegas, Nevada. If you hire me, the signed contract for your job governs that job, and where the contract and this page disagree, the contract wins. This page exists so nothing on it is a surprise.
Quotes and booking
A written quote is good for 14 days. A date is held when the contract is signed and the deposit has cleared, not when we agree in an email that it sounds good. Until both happen, the date is open to anyone else who asks.
Deposits and payments
- A 50% deposit holds your date and is applied to the total.
- The balance is due on delivery, unless your contract says otherwise.
- Deposits and balances can be paid online. Payments are processed by Stripe, and card details are entered on Stripe's hosted checkout, never on this site and never over email.
- Card payments add 7%, which is the processing cost passed through rather than hidden in the rate.
- Overdue balances carry 10% per week from the eighth day after delivery.
- A chargeback filed without talking to me first pauses the job and any outstanding delivery until it is resolved.
- Sales tax applies to physical goods at 8.375%. Session fees and digital files are not taxed in Nevada.
Changing or cancelling a date
- The deposit is not refundable, because holding your date means turning down other work for it.
- One reschedule is allowed with 30 days' notice, subject to my availability, and the deposit moves with it.
- Inside 30 days, a reschedule is treated as a cancellation unless I can fill the date.
- If I cancel, you get every dollar back, including the deposit, and help finding a replacement.
- Weather is not a cancellation for outdoor sessions. We reschedule, or we shoot in it, and the decision is made together on the day.
Delivery and turnaround
- Standard photo turnaround is five business days from the shoot, unless the contract says otherwise.
- Rush delivery inside 48 hours carries a 45% premium and has to be booked as a rush from the start.
- Video edits run 7 to 14 days, sooner by arrangement, with a rush fee where the schedule allows.
- Elopement and wedding timelines are set in the contract, because a ceremony, a film and a gallery are three different jobs.
- Raw files, unedited frames, catalogs and project files are not delivered. Every delivered frame is retouched, and that is the product.
Travel
Nothing in Las Vegas or the Las Vegas Valley carries a travel fee, including Henderson, Summerlin, North Las Vegas and Boulder City. Anywhere else, travel is billed at cost and itemized: flights, hotel, ground transport and per diems, shown as their own lines. East Coast bookings need at least one week's notice, and travel, lodging and ground transport are quoted with the job.
Permits, venues and access
Permits, venue fees, tickets, parking, entry charges and location fees are the client's cost unless the contract says otherwise, and they are quoted up front. Where a venue requires a certificate of insurance naming them, I issue one on request. Where a permit needs lead time, the booking has to respect it, and I will tell you the deadline rather than discover it on the day.
What I need from you
- Access to the site or venue at the agreed time, and a contact who can make decisions on the day.
- Accurate information about headcount, hours and run of show. A station quoted for 60 people is not staffed for 300.
- Permission for anyone whose image is being used commercially, and a parent or guardian on hand where a minor is photographed.
- Prompt payment of venue, permit and travel costs where they are yours.
Copyright and how you can use the work
I own the copyright in every image and film I make. You get a license to use what you commissioned, for the purpose stated in your contract. For corporate and event work that means your company's own marketing, internal use and social channels. For personal work it means you and your family.
- Credit is appreciated, never required on client work.
- Files may not be resold, sublicensed, or used to train models.
- Editorial and commercial clients get the usage rights written into the contract. If you need broader rights, say so before the quote, because it changes the price.
- I may show the work in my portfolio and on social media. If you want a job kept off the portfolio, say so in writing and it stays off.
Prints, products and physical orders
Prints and albums are made to order and are not refundable once production starts. Sales tax applies at 8.375%. Report damage in transit within 7 days of delivery with photographs of the packaging and the piece, and it gets remade. Colors can vary slightly between a screen and a print, and that is not a defect.
Film
Super 8 and 35mm are quoted per project, because stock, processing and scanning are priced at market rate at the time of booking and that market moves. A film order is confirmed when the stock is ordered, and once it is ordered the stock cost is spent. Exposed film is handled with care but is not insured against a lab failure, and if a lab loses or damages a roll you get the proportional cost of that roll back.
Liability
My liability for any job is limited to the fees you paid for it. If files are lost, damaged or corrupted before delivery, I will reshoot at my cost where a reshoot is possible, or refund the fee where it is not, and that is the limit of the remedy. I am not liable for missed moments caused by venue rules, restricted access, late arrivals, or a schedule that changed on the day. Nothing here limits liability for fraud or anything else the law does not allow to be limited.
If something goes wrong
Tell me first. Almost everything is fixable inside a week and a phone call. If it cannot be resolved between us, we agree to attempt good faith mediation before filing anything, and then the dispute belongs in the state or federal courts of Clark County, Nevada, under Nevada law. Either of us can still use small claims court for a small money claim.
The rest
- These terms are governed by the law of Nevada.
- If one clause is unenforceable, the rest survives.
- I may update these terms. The version that applies to your job is the one in force when you signed.
